                                                  Particular Conditions of Use.

1-Book a car on our website or any other channel:

By using our site, you agree to and acknowledge our terms and conditions, if not, please do not proceed.

Your booking is only considered valid once you have made the payment and received your booking confirmation voucher and invoice corresponding to your payment made on our website, otherwise no Booking will be considered valid.

2-Reservation Validations:

We reserve the right to validate or refuse any booking.

 
3-Can I book a car without a credit card?

  • You can book a car without a credit card, for this you will need to add the extra coverage sCDW presented at the time of booking in the protection section on our website.
  • If you do not add our extra sCDW protection, the main driver will need to present a valid credit card in the driver's name and leave the excess deposit/security deposit according to the chosen vehicle category.

4-Driver requirements:

  • All drivers must have in their possession, at the time of delivery of the vehicle, their personal identification document and a valid driver's license for the category of the rented vehicle and must be within the validity period.
  • Please note that if you do not have an EU driving license, you will need to bring an international driving license with you along with your original driving license to rent the car. If your driving licence is written in a non-Roman alphabet (Arabic, Chinese, Japanese, Cyrillic, etc.), it must be supplemented by an international driving licence.
  • At the time of document verification, a copy of your documents is required to legally comply with Portuguese law for car rental, and also for administrative needs.
  • The General Data Protection Regulation (GDPR) and the ePrivacy Directive (ePD) are always applied to the use of documentation.

 

4.1-Additional driver:

Adding a second driver is easy, as long as you have a valid driver's license, are present at the time of pick-up and are of the correct age to drive your chosen vehicle category.

  • Simply select this option as an add-on under "Extras" in the booking process, and the cost will be added to the price.
  • Additional driver 30.00 € per booking (price per additional driver). Maximum number of additional drivers per rental:

Bookings that include a young driver cannot include an additional driver (unless authorised by us).

5-Basic Coverage Rental:

When purchasing the Basic Package (Third Party Cover) Without additional Cover, the driver will have to leave a deposit.

  • The customer will have to present a credit card and a deductible security deposit that will be charged according to the vehicle category booked.

5.1-Deductibles/security deposit and security deposit WITHOUT ADDING EXTRA COVERAGE:

a- Third-party insurance is included in the price of the car rental. In the event of an accident or collision or other situations, the customer will always be responsible for any damage caused to the rented vehicle with the following deductibles.

b-List of rental franchise with basic protection:

  • Group A - 900.00€
  • Group B - 1250.00€
  • Group C - 1500.00€
  • Group C - 7 seats 2000.00€.
  • Group D - 1750.00€
  • Group E - 1750.00€
  • c-. Lost or damaged keys, lost documents, missing/damaged tools, wrong fuel, damage to tires, wheels, glass, and gearbox/transmission and braking system are not included in the package with Base coverage.

d-. The damage will be evaluated on the return of the vehicle, an inspection will be made and compared with the initial report (inspection form), a final damage inspection report (inspection form) will be created, where all damages will be charged according to the damage table sent to the customer on the day of delivery of the vehicle. After the due calculations have been made and the expenses have been calculated, the remaining amount of the deposit will be refunded, if applicable, if there is no incident your deposit will be refunded in full, the return will always be made after the return of the vehicle and never before.

 

              f- Conditions and associated expenses of deposits and guarantees:

  • For rental periods longer than 5 days the deposit will be charged and after the return of the car you will be refunded (Terms and conditions apply) and bank fees will be charged, you will also be responsible for parking in case you have to park the vehicle in paid parking.
  • The Client is responsible for bank fees and any other fees or expenses required for transactions related to franchise deposits.
  • American express cards will always be charged and not pre-authorized for the purpose of a security deposit. Expenses borne by the customer.

6- Reduced Deductible Coverage (CDW):

  • CDW - Collision Damage Liability Reduction.
  • When adding this option as an extra coverage to your rental, you will need to leave a mandatory deposit and you must present a valid credit card in the name of the main driver.
  • In the event of an accident or collision or other event, the driver is responsible for any damage caused to the rented vehicle up to the maximum excess applied.
  • This protection option reduces the renter's liability in the event of an accident or car theft to a maximum amount of:
  • Group A the deductible deposit is reduced from €900.00 to €250.00.
  • Group B the deductible deposit is reduced from €1250.00 to €250.00.
  • Group C the deductible deposit is reduced from €1500.00 to €500.00.
    • With the exception of Group C - 7 seats, the deductible deposit is reduced from €2000.00 to €500.00.
  • Group D the deductible deposit is reduced from €1750.00 to €500.00.
  • Group E the deductible deposit is reduced from €1750.00 to €500.00.

CDW extra protection reduces liability in the event of an accident or car theft, helping renters avoid excessive costs in these events.

Note:

  • Lost or damaged keys, lost documents, missing/damaged tools, wrong fuel, damage to tires, wheels, glass, and gearbox/transmission and braking system are not included in CDW.
  • This option is not valid for Young Drivers (under the age of 24).

6.1-CDW Daily Value:

 7- sCDW Protection, COMPREHENSIVE Coverage, Accidents and Damage to Vehicles:

  • With regard to your rental coverage, you are covered up to €0.00 excess in the event of collision and car theft (with the exception of Group C - 7 Seats, where the excess is reduced to €250.00 when this coverage is added).
  • We offer comprehensive insurance with no deposit (SCDW) - no deposit and no credit card required! (A credit card is not required for the rental in the driver's name.)
  • *This protection option is not available for young drivers. The alternative protection available to young drivers is the "CDW Young Driver".If this cover option is added as a Young Driver, we reserve the right to change your cover option to "CDW Young Driver".
  • In addition, comprehensive total insurance also includes occupant insurance, as well as legally required liability and collision insurance.

7.1-However, added to the sCDW the damages are on account of the customer for the following reasons:

  • Driving under the influence of alcohol (above the legal limit), driving under the influence of drugs, speeding, driving on unpaved roads and paths, extreme dirt and damage to the interior of the vehicle (e.g. broken bottles, fire damage, traces and odour due to smoking inside the vehicle, pet hair, scratches on the dashboard, doors, windows, radio, etc., ) transport of bulky goods (furniture, etc.) or sports equipment (surfboards,paragliders, etc.) any other damage to the interior of the vehicle and under the bodywork due to off-road driving or other reasons.
  • Tire damage when the tire needs to be replaced, e.g., damage to the tire carcass due to improper parking on the sidewalk or prohibited places, e.g., driving on unpaved or off-road roads. (costs see Table of damages).
  • We have several additional protection options that you can add right at the time of delivery of the vehicle. Ask us how.
  • In the event of an accident with someone else, the police should ALWAYS be called so that there are no problems with the insurance later.
  • Parking fines or any other offences issued by the police or other authorities during the rental period will be the responsibility of the renter. If the vehicle is towed for incorrect/improper parking, the renter is required to handle the situation and return it as agreed upon and go to the police to pay the fine(s). Taxi services or transfers, if not authorized by us, are at the customer's expense.
  • We are not responsible for items left inside the vehicle due to theft or any other reason. (In all cases, including trunk and glove compartment). Any damage arising from evidence of an attempt to access the interior of the car for the reasons described herein is the responsibility of the renter.)
  • Lost keys or damaged tools, tank with incorrect fuel after filling.
  • Brake discs, brake pads, gearbox and mechanical clutch failures (our insurances do not cover these breakdowns).
  • Other situations outside of the above will always be resolved in the best way, always in accordance with the terms and conditions.
  • In case of mechanical difficulties or complaints involving your vehicle, it is important that you inform us immediately by phone (+351) 960 003 997 preferably through the WhatsApp channel or by written message.
  • In case of an accident, you must also fill out the friendly accident declaration by the end of the rental period or ask rentADrive for the appropriate form by email or WhatsApp for the proper purpose.
  • The local police (call 112) should also be notified in case of accidents, especially in case there are injuries and a signed police report should be obtained.
  • Try to get the most complete data in the event of an accident, be aware that every detail counts. (Register the car's other registration number with photograph or otherwise take a photo of the insurance policy of the car involved if possible.) You should keep copies of all rental documentation in case an insurance company is involved.
  • Under no circumstances does the customer have the authority or must repair the vehicle rented by him, except if authorized by us, the request must always be made in writing.
  • Your insurance coverage may be invalidated if this procedure is not followed correctly, which can jeopardize any claim for compensation.
  • In the event of an accident/collision with another vehicle, the renter should immediately contact the local authorities and then call RentADrive.pt so that there are no problems with the insurance later (telephone for Portugal: 112). our +351960003997 helpline.
  • In addition, if the Police Report and the "Friendly Statement" duly signed by both drivers are not delivered to RentADrive.pt Rent a Car Madeira, your insurance coverage may be VOIDED.
  • Under no circumstances is any repair of RentADrive.pt vehicles permitted by the customer.
  • We reserve the right to accept third-party insurance. (Example of credit card insurance)
  • In the event of an accident and being found guilty, although you have sCDW protection, you will not be entitled to a replacement vehicle. (It is not a question of full protection in the event of an accident, but the replacement car is never guaranteed.)

Special note for E-Hybrid type car.

Special for the E Hybrid group: In the event of a failure to refuel (lack of fuel), the costs of repairing the system in the event that ignition is not possible by normal process are borne by the Customer responsible in the rental contract.

Important Note:

We reserve the right to APPLY a deposit of €150 on bookings of 1 to 2 days, even when added sCDW.

 

  8- Extra protection for tires and windows:

  • T-Protects your rental with extra costs on tires and windows as long as it is added.
  • Cases of isolated damage to tires resulting from a puncture or other occurrence other than misuse of the tire.
  • It protects the windshield and windows in those situations isolated by objects thrown during the trip or even situations without driver control.
  • Protects tires and windows from vandalism.
  • Daily value varies depending on the vehicle category selected.

9- In the event that it is not possible to deliver the reserved group of vehicles, RentADrive.pt will make a free upgrade of the category of the group of vehicles, according to the following:

  • Group A can be upgraded to any other vehicle group.
  • Group B can be upgraded to groups: B Auto, E Hybrid, C, C Auto, D and C 7-L
  • Group B Auto can be upgraded to groups: E Hybrid, C Auto and C 7-L.
  • The C Suv group can be upgraded to the C Auto, D and C 7-L groups.
  • Group C Auto can be upgraded to groups: group C 7-L.
  • Group D can be upgraded to group: C 7-L.

Note: In the event that the reserved car group is manual transmission and there is a need to upgrade to automatic transmission, we will always contact the renter to ensure that they are comfortable with the different type of transmission.

 

10-Young driver are welcome.

*Special conditions apply. (see below.)

*CDW Collision Damage Waiver (CDW) :

  • Drivers aged 21 or under at the start date of the rental or with less than 2 years of driving licence, when approved by us, must leave a security deposit of €500.00, even when adding the CDW Young Driver.
  • Drivers who are 22, 23 or over 70 years old at the start date of the rental or with less than 3 years of driving licence, when approved by us, must leave a security deposit of €250.00, even when adding the CDW Young Driver.
  • A young driver is considered to be a driver who is 23 years of age or younger and who has held a driving license valid for more than 1 year or less than 3 years. In these cases, a young driver fee of €30.00 automatically applies.

If you do not add the CDW Young Driver extra  , the amount of the deposit is:

  • Group A - 900.00€
  • Group B - 1250.00€
  • Group C - 1500.00€
  • Group D - 1750.00€
  • Group E - 1750.00€

*Senior Driver:

A Driver is considered a senior driver when at the start date of the rental he or she is 70 years of age or older. In these cases, a fee of €30.00 applies. (This type of rental will need to be validated by us and the same conditions may apply as for a young driver.)

 

 11-Conditions and Prices:

ONLINE conditions and prices are exclusive for online bookings.

 

12-Delivery and Return Vehicles:

  • We deliver the car to the P0 Car Park under normal conditions at the airport.
  • There is no transfer service by any kind of shuttle /Taxi etc, unless indicated by us.
  • We will contact you on your arrival with instructions. Pay attention to your mobile phone, we will contact you with the number you left us on your rental form.
  • The customer will receive the vehicle, with maintenance carried out and in good conditions of cleanliness, with the respective mandatory documentation, including the rental contract and must be returned in the same condition in which it was delivered.
  • All drop-off and drop-off locations will be according to the booking made. Changes of location are possible, but contact must be made in advance 24 hours in advance. (contacting RentADrive at the email: rentadrive@rentadrive.pt)
  • If the option is airport, a RentADrive.pt – Rent a Car Madeira employee will be waiting for you next to the car, usually the delivery will be made at the P0 airport car park.
  • Flight delays are not covered in the price and additional fees may apply.
  • In the collection and return, a visual damage check will be made in the presence of the customer, a report will be issued and validated by the customer, through his signature, which validates it. (Night pickups may be an exception if in doubt.)
  • Vehicles must be returned with the same level of fuel delivered, additional charges will apply if these conditions are not met, additional fuel on return of the vehicle will not be refunded.
  • If necessary, vehicles can be replaced by others in the same group or higher, depending on availability.
  • The images of the vehicles presented in the booking process are for group identification only.
  • Exterior/interior features and colors may differ from the vehicle being rented.
  • The number of passengers is limited to the official seats of the vehicle. (With the exception of "Group A (2 people)" which are limited to 2 adults maximum and RentADrive may refuse to deliver the vehicle if these conditions are not met).
  • The Personal Assistance Coverage insurance in the event of an accident is valid for the driver and passengers.
  • Vehicles should never be abandoned on their return or at any time during the rental.
  • If for any reason the vehicle is abandoned or returned without the customer present, the vehicle inspection record by RentADrive will always prevail.
  • All liabilities, such as parking tickets, speeding fines, etc., will be charged to the customer's credit card, including all legal liabilities and administrative or other fees.
  • In the event of an accident and being found guilty, although you have sCDW protection, you will not be entitled to a replacement vehicle.

Note:

In the event of a vehicle breakdown caused by the rental driver, the driver will be responsible for this damage and no replacement vehicle will be provided without a new rental agreement. In addition, if the customer has not contracted 24/7 roadside assistance EXTRA does not cover replacement car because of a road problem (such as a flat tire or other breakdown), the customer will be responsible for the cost of the tire or necessary repair, as well as the cost of towing if it is necessary. If the vehicle breaks down in the customer's possession during the rental period for no apparent reason, RentADrive.pt will provide all necessary assistance as soon as possible.

13-Return of the car:

  • Return as agreed in the rental agreement. (Fees apply if this condition is not met)
  • Return of the vehicle after hours we still offer free return at the airport or in Funchal but depending on the situation we may ask to return the vehicle to the Car Park informed by us at the time of return of the vehicle, by message or by email.

Note:

Out of hours rate applies at these times (Night/out of hours rate of 25.00€):

  • Madeira Airport, Funchal, Câmara de Lobos and Caniço area - The off-hours period is from 8:00 pm to 8:00 am.
  • Other locations - Out of hours is from 7:00 pm to 8:30 am.

Observation:

Delivery of a car outside normal hours will be automatically applied at the time of booking a fee of €30.00. Monday to Sunday, from 8:00 pm to 8:00 am

Return of a vehicle outside normal working hours will automatically apply a fee of €30.00.

Monday to Sunday, from 8:00 pm to 8:00 am.

If there is a need to return the car to another alternative Meeting Point, RentADrive.pt guarantees the driver's transportation to the departure terminal at the Airport.

Especially at night, or on busy occasions.

 Note:

We deliver to any location on the island:

A delivery fee may be charged.

In some locations we offer FREE delivery such as Funchal and Airport.

14-Fuel Policy

The RentADrive.pt follows an "Equal to Equal" Fuel Policy, which means that the vehicle's fuel level at the time of delivery must match the fuel level on the way back.

  • Fuel level at pick-up: The vehicle will be delivered with a specified amount of fuel, which will be recorded at the start time of the rental.
  • Fuel level on return: The customer must return the vehicle with the same level of fuel that was delivered to him at the time of delivery of the vehicle.
  • Failure to return the vehicle with the same fuel level may result in additional refueling fees.

15-Extra "Refueling Service"

With the optional extra service "Refueling Service", RentADrive.pt provides customers with the convenience of returning the vehicle with less fuel than what was provided at the time of delivery, agreeing to the next refueling and collection procedure.

By selecting this optional service, customers agree to the following terms:

  • Tank at the time of Delivery: The vehicle will be delivered with a specific amount of fuel, which will be documented at the beginning of the rental.
  • Return with less fuel: Customers can return the vehicle with less fuel than provided at pickup. The RentADrive.pt will handle the refueling process and send payment to the customer, with no fuel administration fees.
  • Valid credit card requirement: A valid credit card must be associated with the reservation for this service. The credit card will be used to cover the cost of fuel on return.
  • Refueling and Collection Process: After the vehicle is returned, the RentADrive.pt team ensures refueling and will charge the cost of the same to the customer's credit card based on the price per liter on the day.

15.1-By adding the "Refueling Service", customers acknowledge and agree to these terms and conditions, allowing RentADrive.pt to process the necessary fuel charges as described.

 15.2-In the case of introduction of fuel of a different type from the one used by the vehicle, the Customer is responsible for the expenses inherent to the full replacement of the fuel, disassembly and washing of the tank, tuning of the engine and other damages caused to the vehicle, without opposition to its amounts.

16-Can I take the rental car out of the island of Madeira?
No, the customer is not authorized to transport the vehicle to Porto Santo Island by ferry or out of the island of Madeira.

Our vehicles are not allowed to leave Madeira Island, The customer will be responsible for all charges resulting from non-compliance.

17- Payments:
RentADrive.pt - Rent a Car Madeira has several types of payments and in some situations there may be deposit fees or other types of advances. When making online reservations we have the following payment methods available:

                     a- Credit or Debit Card through the Stripe system (Payment in advanced 3D security system.

17.1- On delivery of the vehicle we have the following payment methods:

  • Visa Debit or Credit Card, Mastercard, including REVOLUT, MBWAY, Cash, PayPal and STRIPE. - Payment is made at the time of delivery of the vehicle, American Express Cards ARE WELCOME.

 

18-Prices, taxes and rental period:

  • Our services will be invoiced with VAT and all taxes that comply with Portuguese standards and legislation.
  • All prices include taxes in accordance with the Portuguese Financial Law.
  • Extra coverage is provided as an extra and is detailed in your rental agreement which you can add at the time of your booking in the extras and protection section. (Not mandatory, all our vehicles are covered against third parties by law).
  • The minimum rental period is 24 hours. If the return date is not respected, an additional fee may apply and the authorities will be notified as a "lost/stolen car".
  • Tolerance of delay in vehicle return 0 hours.


19-Prices and Seasons:
 Prices may change in high seasons, such as Christmas/New Year's Eve, Easter, Flower Festival, summer or other special events and dates due to the high demand for vehicles.

20-Rental cancellation procedures:

  • Cancellations must be informed by email (rentadrive@rentadrive.pt) no later than 48 hours before the rental start date.
  • It can be cancelled or modified up to 48 hours before the start of your reservation, and the refund of the amounts paid will be made by the same method in which the payment was made, deducted from the respective bank fee and administrative fees of €25.00.
  • Cancellations 7 days before the pick-up date and time will be refunded in full (except for Group C - 7 seats, where free cancellation is possible up to 30 days before the pick-up date and time).
  • However, if you have already collected your vehicle, made the payment and decided to return it before the deadline, our policy is not one of refunds. (In any situation.)

 

21-NO-Show:

  • In car rental, the no-show is the situation in which the Renter/Customer/Driver is unable to make the reservation and does not attend the scheduled delivery.
  • There will be a charge for a no-show situation, where the customer will be responsible for all charges, including penalties, administrative fees, and rental period fees.
  • Prepayment means that you have paid your rental in advance at the time of booking, which will not be refunded.
  • NO-Show Rates Prepayment Rentals:

21.1-No-show are charged the full rental price if the customer does not show up before the delivery time. (Tolerance without notice 1 hour)

21.2-The fee is 100,00 € if you cancel up to 24 hours before the scheduled delivery.

21.3-The fee is 50,00 € if you cancel more than 24 hours up to 48h before the scheduled delivery.

e- No penalty for no-show:

21.4-In the event of cancellation of a flight, we will not charge a fee since a flight number and airline were provided in the booking before the scheduled delivery, also a written statement with the details/reasons for the flight cancellation. (Example airline email)

 22-Applicable Law and Jurisdiction:

  • The rental contract is made in accordance with Portuguese Laws.
  • Any divergences will be competent to the Judicial Court of the District of Madeira, with waiver of any other.

23-Validity of the Rental:
 Any and all changes to the terms and articles of this Agreement that have not been agreed to in writing will be null and void.

 

24-Errors:
 Obvious errors and obvious typographical errors are not binding. For example, if you book a car that was mistakenly offered for 1 EUR, your booking may be cancelled and we will refund any amount paid.

 25-The Client may submit his Complaint:

In the Physical Complaints Book available at our Station, or through the Electronic Complaints Book, available at https: www.livroreclamacoes.pt

26-Pairing and using the audio system:

  • It is the customer's responsibility to delete their user profile after returning the car on our car audio system.
  • We are not responsible for any information left as an example: contact list.

27-Personal Data:

  • Who is responsible for the processing of your personal data. 28-Translation.

The translations of these General Conditions and the Specific Rental Terms are merely informative and do not have a binding legal character in their entirety, and only their version in Portuguese is valid.

 

29-Final note:

These conditions are complemented by the terms and conditions of rental of the company Pedro e Nino Gomes Lda referred to herein as RentADrive.pt, which can be sent to the customer at his request through the contact e-mail rentadrive@rentadrive.pt.
